UK mulls energy legislation change proposals after Brexit

The United Kingdom Department for Business, Energy & Industrial Strategy (BEIS) has published a statement of intent for legislative changes in the wake of the Brexit. The European Union Withdrawal Act 2018 will legally ensure that all the current EU legislation is enshrined into UK law by March 2019 with functions transferred from EU public bodies to UK departments.

Several changes are proposed to EU directives concerning gas and power network transmissions and in particular conditions for access to the network for cross-border electricity and gas exchanges. The EU legislation which will be amended includes namely: the regulation No 714/2009 on conditions for access to the network for cross-border exchanges in electricity, the regulation No 715/2009 on conditions for access to the natural gas transmission networks, the REMIT regulation No 1227/2011 on wholesale energy market integrity and transparency and the Regulation 2017/1938 (Security of Gas Supply Regulation).

Besides, the BEIS has also unveiled a forecast regarding how the civil nuclear industry and stakeholders will be affected in the UK in the unlikely event that the UK leaves both the European Union and Euratom in March 2019 with no agreement in place.
