The Supreme Court of Spain has admitted seven new appeals against the ministerial order in which the obligations of contribution of each company are set to the new National Energy Efficiency Fund. Among the appellants are the National Federation of Employers of Electrical Installations and Telecommunications of Spain (Fenie), the Association of Independent Power Marketers, Acciona, HC (EDP's Spanish subsidiary), E.ON, Nexus, Tamoil, as well as smaller electricity distributors integrated in Cide HC Energia. Previously, Cepsa, Disa and the Spanish Association of Oil Product Operators (AOP), which represents the major oil companies in the country including Repsol, BP, Galp, Saras and Shell, appealed the ministerial order.
The order from Ministry of Industry, Energy and Tourism published in February 2015 details the mandatory contributions of 240 energy companies to the new efficiency fund with the aim of saving €243m through efficiency measures in 2015. Under this new obligations scheme, companies must save an energy equivalent of 1.5% of sales per year. In compliance with the EU directive, Spain is expected to save 15.9 Mtoe between 2014 and 2020.
