A coalition of nine US states (California, Connecticut, Delaware, Maine, Massachusetts, New Jersey, New York, Rhode Island, and Vermont) have filed lawsuits against the US Department of the Interior, challenging federal agreements that cancel offshore wind leases and provide federal payments to developers that redirect investments to other energy projects (US state of New York press release, 22/09/2026).
The lawsuits target agreements involving Invenergy and Bluepoint Wind. According to the complaints, the federal government agreed to provide more than USD653m for the cancellation of three Invenergy offshore wind leases and USD765m for a Bluepoint Wind project. The states argue that the agreements violate several federal laws.
In a separate case, California challenged the cancellation of Invenergy’s Morro Bay offshore wind lease off the California coast. The complaint states that the agreement includes more than USD111m in investments redirected to fossil fuel and other energy projects in exchange for federal reimbursement (California Attorney General press release, 22/09/2026).
The lawsuits seek to invalidate the agreements and restore the cancelled leases. According to California, the state’s offshore wind strategy targets 25 GW of offshore wind capacity by 2045, supported by more than USD100m already invested in ports, transmission infrastructure and related industries.
