The German government seeks legal power to expropriate energy firms

The German government has approved an amendment to the country's Energy Security Act that would allow future expropriations of energy companies as a last resort in case of an emergency in energy markets. The measure could be applied if the companies no longer fulfil their tasks and the security of supply is at risk. In addition, the amendment requires planned decommissioning of gas storage facilities to be reported to the Federal Network Agency in the future. The amendment must still be adopted by the Parliament to enter into force.

Earlier in April 2022, the German Federal Ministry for Economic Affairs and Climate Action (BMWK) temporarily appointed the energy regulator Bundesnetzagentur as fiduciary for the Gazprom Germania Group until 30 September 2022.
