German court dismesses EnBW's claims over 2011 nuclear plant closure

A regional court in Bonn (Germany) has rejected EnBW's claim for compensation over the three-month shut-down of old nuclear power plants decided by the German government in the wake of the Fukushima disaster in March 2011.

That decision had affected EnBW's Neckarwestheim 1 and Phillipsburg 1 nuclear reactors in Baden-Würrtemberg but the utility failed to immediately seek a court injunction against the nuclear moratorium and even declared that it would not contest the policy in courts. However, German court decisions in favour of RWE in 2013 and 2014 over the shut-down of the Biblis nuclear plant incited EnBW to file a lawsuit in December 2014 and to claim €261m.

E.ON is also seeking damage; the group filed a €380m compensation claim in early 2014 and may be dismissed as EnBW. In addition, all four largest utilities in Germany (including Vattenfall) have filed litigation against the nuclear fuel tax and against the permanent shut-down of nuclear reactors.
