Brazil’s Federal Senate has approved the country’s offshore wind bill, passing the legislation on to the President for final approval. The (PL) 576/2021 bill regulates the generation of energy through the force of offshore winds, prohibiting the exploitation of this energy in shipping lanes, sites of military activities and areas listed as cultural and natural heritage. The contract for the assignment of offshore areas use will be divided into two phases: evaluation for analysis of economic and environmental feasibility and execution for implementation and operation. The public notice of the grant will include mandatory clauses on the delivery of reports to the National Electric Energy Agency (Aneel), promotion of the national industry and sanctions in case of non-compliance with obligations. The text also provides for measures to encourage the production of solar energy.
The bill includes articles with incentives for the production of gas-fired and coal-fired power plants, requiring to contract coal-fired power plants and to operate them up to 70% of the days of the year, in reserve capacity auctions, an obligation expected to end by 2028. The proposition also provides for the contracting of natural gas-fired thermoelectric plants for a longer period throughout the year, and not only when there is a risk of electrical insecurity. The bill will now have to receive presidential sanction to become a law.
Brazil targets a share of 45-50% of renewables in its energy mix for 2030 and a 53% cut in GHG emissions in 2030 compared to 2005.
